Legally, he can't use the Mario trademark at all. That said, it has already been used a million times. That said, I don't think anything bad will happen to the project. At least not at first. Hopefully never. I can't wait to play it. I bet if he had to stop making it, he'd just remove the graphics and offer the code to anyone who wanted it. It's really just the graphics that Nintendo would have a problem with. Hopefully since he's not selling it, he won't have a problem like the 2D Ocarina remake had.

Nothing will ever be as big as Minecraft for a long time. Even Super Meat Boy, but it could probably get pretty popular. If Nintendo notices and shows anger, I say just change the graphics to a generic platformer but keep the engine. Can't wait to see what he shows off tomorrow. I wish he'd stop by the forum. I'd have created a MariO topic, but it would be nice if he did it himself maybe when it's done.
