Ok, it's clear now that you mention this happens when an error occurs. This is not a bug, it's expected behaviour the way the current code works. Feel free to open a ticket in the issue tracker if you feel the console should be activated sooner.
In the meantime, start the console with love._openConsole() in conf.lua. This really should work as demonstrated in this example.

I believe so-called expected behaviour is a erratic behavior.
console_and_error.love works but it shouln't have been that tricky to view the console
